These Terms set out the conditions of use of the website https://www.hitohata.jp/ (the "Site") operated by HITOHATA, INC. ("we", "us" or "our"). By using the Site, you are deemed to have agreed to these Terms.

Article 1 (Copyright and Intellectual Property Rights)

Copyright, trademark rights and all other intellectual property rights in the text, photographs, video, music, illustrations, logos, designs, programs and all other content published on the Site (the "Content") belong to us or to the third parties who have licensed their use to us (hosts, co-hosts, owners of cultural properties, artists, performers and others). The projection mapping, immersive art museums, immersive shows and other works we have produced, and the names, logos, characters and footage of "Ukiyo-e Immersive Art Exhibition", "YOKAI Immersive Exhibition" and similar properties, are important intellectual assets of ours.

Beyond private use and other cases permitted by law, the Content may not be reproduced, reprinted, altered, distributed, publicly transmitted or used secondarily without our prior written permission. For use for news coverage, reporting or educational purposes, please consult us through the inquiry form.

Article 2 (Filming at Our Works and Event Venues)

Whether filming, sound recording or video recording is permitted at the events and facilities we host, co-host or operate, and the conditions for publication, are governed by the terms and signage of each event or facility. Even where filming is permitted, the commercial use of the footage or music of a work, the infringement of other visitors' rights, and any conduct that interferes with operations are not permitted.

Article 3 (Prohibited Conduct)

The following conduct is prohibited in connection with the use of the Site.

(1) Conduct that infringes our or a third party's copyright, trademark rights, portrait rights, privacy, reputation or other rights

(2) Conduct that interferes with the operation of the Site, unauthorised access, excessive access, and bulk acquisition using automated collection tools

(3) Transmission of false information and impersonation

(4) Use of our works, names or logos to promote your own products or services without our permission

(5) Conduct that violates laws or public order and morals

Article 4 (Disclaimer)

We exercise reasonable care regarding the accuracy, completeness and currency of the information on the Site, but do not guarantee it. The information on the Site, including event periods and content, is subject to change without notice. We are not liable for damage arising from the use of, or the inability to use, the Site, except where caused by our wilful misconduct or gross negligence. We are not responsible for the content of third-party websites linked from the Site.

Article 5 (Links to the Site)

Links to the Site are in principle free. However, we decline links from websites that may damage the reputation of us or our works, display within a frame, and links presented in a manner that may create the misleading impression of an affiliation with or endorsement by us.

Article 6 (Trademarks)

"HITOHATA", "一旗", "Ukiyo-e Immersive Art Exhibition", "YOKAI Immersive Exhibition", "Ukiyo-e Immersive Museum" and the other names, logos and work titles displayed on the Site are our trademarks or trade names.

Article 7 (Exclusion of Anti-Social Forces)

We have no relationship whatsoever with organised crime groups, their members or quasi-members, corporate racketeers, groups engaging in criminal activities under the pretext of social movements, specialised intelligence violence groups or any similar parties (collectively, "Anti-Social Forces"), and we respond firmly to improper demands from Anti-Social Forces in cooperation with the police, lawyers and other external specialist institutions. If it becomes clear that a client or partner is an Anti-Social Force, we may terminate the transaction.

Article 8 (Recommended Environment)

We recommend viewing the Site with the latest version of a major browser. Depending on your environment, some displays or functions may not operate correctly.

Article 9 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan, and the Nagoya District Court shall be the exclusive court of first instance for disputes relating to the Site.

Article 10 (Amendment of These Terms)

We may amend these Terms as necessary. The amended Terms take effect from the time they are posted on the Site.
